Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of CraftLeads ("the Service"), an AI-powered sales prospecting platform operated by Mostly Harmless Code SA, a company registered in Switzerland ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

2. Service Description

CraftLeads is a SaaS platform that helps businesses automate sales prospecting. The Service finds companies via public data sources, enriches them with website data, qualifies them using AI scoring, and generates personalized outreach emails. The Service is provided on a subscription basis.

3. Account Terms

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • One person or legal entity may maintain no more than one account.
  • You must be at least 18 years old to use the Service.
  • Authentication is handled through our third-party provider (Clerk) using Google OAuth or email-based sign-in.

4. Acceptable Use

You agree to use the Service in compliance with all applicable laws, including but not limited to:

  • Anti-spam laws such as CAN-SPAM (US), GDPR (EU), and the Swiss Federal Act on Data Protection (FADP).
  • You will not use the Service to send unsolicited bulk emails or spam.
  • You will not use the Service to collect data for purposes other than legitimate business prospecting.
  • You will not attempt to reverse-engineer, decompile, or disassemble any part of the Service.
  • You will not use automated means to access the Service beyond the provided interfaces.

5. Payment Terms

  • The Service is offered on a subscription basis with pricing as listed on our pricing page.
  • Payments are processed securely through Stripe. We do not store your payment card details.
  • Subscriptions renew automatically at the end of each billing period.
  • You may cancel your subscription at any time. Access continues until the end of the current billing period.
  • Prices may change with 30 days' notice to active subscribers.

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Mostly Harmless Code SA and is protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any data you input into the Service. We retain ownership of the AI-generated content produced by the Service, but grant you a non-exclusive license to use such content for your business purposes.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Mostly Harmless Code SA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. AI-generated content may contain inaccuracies, and you are responsible for reviewing all content before use.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account data by contacting us at support@craftleads.ai.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a notice on the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Switzerland. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Canton of Vaud, Switzerland.
